In order to increase legal certainty in Serbia, the Ministry of Justice has developed a new module called "Search eZIO" within the "ProNep" application, through which notaries public will be able to check whether a decision on enforcement has been issued for aproperty subject to sale.

The new module has been in operation since 17 January 2020, and the primary objectiveis to increase the security of real estate transactions.

In the course of real estate transactions, notaries public can now electronically inspect the data on enforced debtors in respect of which the operated real estate was designated to be the subject of enforcement.

Notaries public examine information from enforcement decisionsrendered in enforcement and security procedures after 1 November 2018. These data pertain to real estate entered in the cadastre and to debtors on whom the sale of real estate has beenimposedas the subject of enforcement, which is conducted by a public bailiff.

The Procedure for Registration in the Real Estate Cadastre and Power Lines Act stipulates that public bailiffs shall submit enforcement decisions via e-mail in cases and in the manner prescribed by the Enforcement and Security Act, which represent a suitable legal basis for registration in the real estate cadastre. That obligation shall be effective as of 1 November 2018.

It is planned that this database will be extended in the upcoming period to real estate not registered in the cadastre, which will completely prevent the possibility of the creditorsto collect their claims on the real estate subject to settlement in anenforcement procedure.
