Assistant Justice Minister Jelena Deretić attended the Annual Conference of Commercial Courts in Zlatibor where she presented some of the most important amendments to the Enforcement and Security Act which had been adopted in late July.
On the occasion, Ms Deretić announced the introduction of e-notice boards to our system of electronic acquisition of property and real estate. She explained that the main reason for this introduction was to overcome the problem of disorderly physical notice boards which the users had faced for years, and thus to increase transparency in the enforcement proceedings.
Ms Deretić added that the subject portal would be available on a special webpage, and that the search criteria for the parties to and the participants in the proceedings would be their unique identification numbers, i.e. personal identification number assigned at birth in case of private persons and registration number or taxation identification number in case of legal entities. She said that the development of a text message service (SMS) was planned, which would notify the parties to the proceedings when a specific submission has been placed on the notice board.
Ms Deretić also noted that the Ministry of Justice had prepared a draft bylaw which entirely regulated the e-auction, in line with the revised provisions of the statute governing the sale of property and real-estate for the purpose of settling a monetary claim as means of enforcement. “Public sales in their present format are an obstacle to the efficiency of enforcement proceedings, as well as the weakest point of the proceedings“, Ms Deretić noted.
Ms Deretić highlighted the USAID Rule of Law Project’s support in the drafting of the bylaws and the development of the e-notice board application.
