Today, Justice Minister Nela Kuburović visited the members of the Amendments to the Enforcement and Security Act (ESA) Working Group. She highlighted that the amendments to the said statute needed to eliminate all performance unclarities and irregularities which currently existed.

Kuburović commended the continual efforts of the Working Group since its formation in March 2018. She explained that the purpose of the Amendments to the ESA was to harmonise the courts’ and the bailiffs’ enforcement practices. She added that one of the amendments which the Working Group was preparing concerned the introduction of an e-auction which would ensure more transparent sales of real-estate in enforcement proceedings.

The Justice Minister highlighted that she expected the public debate on the Draft Amendments to be held at the seats of the appellate courts, following which the final consolidated draft would be submitted to the relevant institutions for an opinion. ‘Firstly, I would like to thank you for your tremendous commitment. I believe this may be one of the largest working groups of the Ministry of Justice, if not of all the ministries. I am confident we are applying a good practice, one which we had established during the ESA adoption in 2015, and in the drafting of which most of today’s Working Group members took part’, Kuburović said. She added that the Ministry of Justice was prepared to accept many of the proposed amendments which were substantial in nature, rather than cosmetic.

President of the Bailiffs Chamber Aleksandra Trešnjev stated she believed the Draft Amendments - which the Working Group had been preparing for several months - to be very important for the general public and the professional community because enforcement, as the final stage of civil case proceedings, gave meaning to the overall adjudication. Adding to the point, Trešnjev explained that the Bailiffs Chamber’s great interest in and commitment to the Working Group were evident in fact that four of its representatives were members of the Group.

The USAID and the EU are supporting the Amendments drafting efforts through the “Rule of Law” and the “EU for Justice” Projects, respectively.
